United States Fourth Circuit
In Re: Norfolk Southern Railway Co., 13-2112
Petitioner's appeal from a district court order remanding to state court a claim brought against petitioner pursuant to the Federal Employers' Liability Act is dismissed, where this court lacks jurisdiction to review the district court’s order on appeal because: 1) 28 U.S.C. section 1447(d) bars review of the district court's order by appeal or via mandamus; and 2) petitioner has not established entitlement to mandamus relief because it has not shown a clear and indisputable right to such relief.
