US v. Adepoju, 12-5007
Defendant's convictions and sentence for bank fraud and aggravated identity theft are: 1) affirmed in part, where the convictions are supported by sufficient evidence, and there was no due process violation; but 2) vacated in part and remanded for resentencing, where the facts do not affirmatively demonstrate sophisticated means in his attempt to commit bank fraud, so the district court erred in imposing a two-level enhancement for using sophisticated means.
