US v. Mungro, 13-4503

Defendant's sentence for being a felon in possession of a firearm is affirmed, where: 1) North Carolina's "breaking or entering" offense qualifies as burglary and, thus, as a predicate offense under the Armed Career Criminal Act (ACCA); and 2) the district court did not err in concluding that defendant was subject to a mandatory minimum sentence of 15 years' imprisonment under the ACCA due to defendant's three prior state convictions for "breaking or entering" in violation of N.C. Gen. Stat. section 14-54(a).
