United States Fourth Circuit

US v. Barefoot, 13-4108

Defendant's multiple convictions and sentence are: 1) affirmed in part, as to Counts One through Four for conspiracy to receive, possess, conceal, store, barter, sell, and dispose of stolen firearms, possession of stolen firearms, solicitation of another to assist in damaging and destroying by explosive the Johnston County Courthouse and Sheriff’s Office, and receiving an explosive with the intent that it be used to kill; 2) reversed in part, as to Counts Five and Six for improperly storing explosive materials, and distributing explosive materials to an individual under twenty-one years of age; but 3) affirmed as to the sentence, where the latter two convictions do not materially affect defendant's sentence, which was otherwise properly calculated, so remand for resentencing is not necessary.
