United States Fourth Circuit
Fowler v. Joyner, 134
The district court’s denial of petitioner-inmate's petition for a writ of habeas corpus challenging his first degree murder conviction and death sentence is affirmed, where: 1) the North Carolina state court's rejection of petitioner's claim that an eyewitness’s in-court identification violated his due process rights under the Fourteenth Amendment was not contrary to, or an unreasonable application of, clearly established federal law, as determined by the United States Supreme Court; and 2) even if there was error, it was harmless.
