US v. Ferguson, 13-4396

The district court's judgment revoking defendant's supervised release is reversed and remanded, where: 1) the district court found that defendant had violated the terms of his supervised release by, among other things, possessing marijuana; 2) this finding relied in part on a laboratory report prepared by a forensic examiner who did not testify at the hearing; and 3) the district court erred by denying defendant a chance to cross-examine this forensic examiner, and this error was not harmless.
