US v. McFadden, 13-4349
Defendant's convictions involving the sale of "designer drugs," in violation of the Controlled Substance Analogue Enforcement Act of 1986 are affirmed, where: 1) the Act is not unconstitutionally vague as applied to defendant; 2) the district court did not abuse its discretion in making certain evidentiary rulings at trial; and 3) the government carried its burden of proving that the substances defendant distributed qualified as controlled substance analogues under the Act.
