US v. Carter, 12-5045

Defendant's conviction for possessing two firearms while being an unlawful user of and addicted to a controlled substance, in violation of 18 U.S.C. section 922(g)(3), is affirmed, where the district court correctly concluded that: 1) the government adequately demonstrated a reasonable fit between its important interest in protecting the community from gun violence and section 922(g)(3), which disarms unlawful drug users and addicts; and 2) that section 922(g)(3) is therefore constitutional under the Second Amendment.
