In a case brought under the Administrative Procedure Act (APA) presenting numerous issues relating to transparency of federal courts and the public’s constitutional and common-law rights of access to judicial records and documents, seeking to enjoin the US Consumer Product Safety Commission from publishing online a report that attributes the death of an infant to a product manufactured and sold by plaintiff, the District Court's order denying the intervention of interested consumer groups, who objected to the sealing and redaction of documents related to this litigation, is vacated where: 1) the sealing order violates the public's right of access under the First Amendment; and 2) the district court abused its discretion in allowing plaintiff to litigate pseudonymously.
