US v. Blackman, 13-4406
The district court's judgment convicting defendant of two counts stemming from his participation in a series of armed robberies but denying the government's request for forfeiture is: 1) affirmed in part, as to defendant's conviction, where the prosecution's evidence was plainly sufficient to support defendant's conviction under Pinkerton for brandishing a firearm during and in relation to a crime of violence, and the indictment put defendant on notice that his participation in the robbery conspiracy was relevant to the alleged firearm offense; but 2) reversed in part, and remanded as to the district court's forfeiture ruling, where said ruling was unsupported by any relevant legal authority.
