In an action to quiet title arising out of competing claims of ownership to the gas rights underlying a 3,800 acre plot of land located in northern West Virginia, summary judgment for plaintiffs is: 1) affirmed in part as to three out of the four plaintiffs, where there was no error in any of the district court's decisions; but 2) vacated in part with respect to the judgment for plaintiff Republic Energy Ventures, LLC, where, in order to retain jurisdiction, the court exercises its authority to dismiss that party.
