Clark v. Absolute Collection Service, 13-1151
Dismissal of plaintiffs' putative class action under the Fair Debt Collection Practices Act (FDCPA) alleging that defendant's collection notice violated the FDCPA by stating that debtors could only dispute the validity of their debt in writing, is vacated and remanded, where the 15 U.S.C. section 1692g(a)(3) of the FDCPA permits consumers to dispute the validity of a debt orally, and it does not impose a writing requirement.
