North Carolina Utilities Commission v. FERC, 12-1881
In a challenge to incentives granted by the Federal Energy Regulatory Commission (FERC) to a Virginia electric power company (VEPCO) to encourage investment in transmission infrastructure projects is affirmed, where FERC properly exercised its broad discretion in declining to apply the 2010 policy change in its Rehearing Order and in evaluating VEPCO's application for incentives.
