Temu v. Holder, 13-1192
The Board of Immigration Appeals' (BIA) denial of petitioner's asylum application is vacated and remanded, where: 1) the BIA erred in concluding that petitioner's proposed group of "individuals with bipolar disorder who exhibit erratic behavior" did not qualify as a "particular social group;" and 2) the BIA's conclusion that petitioner was not persecuted because of membership in his proposed group is contradictory to the undisputed facts of the case.
