Swatch AG v. Beehive Wholesale, LLC, 12-2126
The district court's order denying plaintiff's opposition to defendant's trademark application and dismissing plaintiff's related claims for federal, state, and common law trademark infringement, trademark dilution, and unfair competition, is affirmed, where the district court did not err in finding that: 1) there is no likelihood of confusion between the parties' marks; and 2) defendant's mark is not merely descriptive.
