Occupy Columbia v. Haley, 13-1258

In an action brought by plaintiff-protestors under 42 U.S.C. 1983 against government officials for arresting them during a protest on State House grounds, the district court's denial to defendants of qualified immunity is affirmed, where plaintiffs have alleged a violation of a clearly established First Amendment right, that is, the right to protest on State House grounds after 6:00 p.m. in the absence of a valid time, place, and manner restriction.
