Perini/Tompkins Joint Venture v. ACE American Insurance Company, 12-2415
Summary judgment in favor of defendant-insurer in an action in which plaintiff sought coverage under primary and excess insurance policies with regard to a large-scale construction project, is affirmed, where: 1) under Maryland and Tennessee law, plaintiff violated the terms of both the primary and excess policies by not obtaining defendant-insurer's consent before settlement; and as such, 2) plaintiff cannot now claim reimbursement under those policies.
