US ex rel. May v. Purdue Pharma L.P., 12-2287
Dismissal of plaintiffs' False Claim Act action alleging that defendants falsely marketed its narcotic pain medication OxyContin to physicians as being twice as potent as a cheaper, off-patent drug, is vacated and remanded, where: 1) the action is not barred by res judicata; and 2) the matter is remanded to the district court for discovery and other proceedings as necessary to resolve the issues related to the applicability of the public-disclosure bar.
