Seney v. Rent-a-Center, Inc., 13-1064

In an action in which plaintiffs alleged a bedbug infestation resulted from the rental of a bed from defendant, the district court’s order compelling arbitration of plaintiffs' breach of warranty claim under the Magnuson-Moss Warranty Act is affirmed, where: 1) the district court erred in holding that the FTC regulations contain no ban on binding arbitration; but 2) the FTC ban on binding arbitration does not apply to the plaintiffs' contract with defendant because the regulations do not reach warranties included in leases.
