Pastora v. Holder, 12-2095

A petition for review of the immigration courts' denial of relief from removal to petitioner under the Nicaraguan Adjustment and Central American Relief Act (NACARA) is denied, where: 1) the record contains evidence sufficient to trigger the applicant’s burden of proving that he did not engage in persecution in his home country; and 2) the Board of Immigration Appeals and the Immigration Judge properly determined that petitioner did not meet his burden.
