Injeti v. United States Citizenship and Immigration Services, 12-1167

Summary judgment for defendant on plaintiff's challenge to defendant's decision that she was ineligible for naturalization is: 1) affirmed in part, where plaintiff's misrepresentation on her lawful permanent resident (LPR) application was material, plaintiff did not satisfy the legal requirements for adjusting to LPR status, and she is therefore ineligible for naturalization; but 2) vacated in part and remanded, where the district court's finding that plaintiff's unlawful acts barred a finding of good moral character was not essential to the district court's grant of summary judgment.
