United States Fourth Circuit

Durham v. Jones, 12-2303

Judgment for plaintiff in an action in which he alleged that he was terminated in retaliation for the exercise of his First Amendment rights is affirmed, where the district court did not err in declining to grant qualified immunity to the defendant-Sheriff because: 1) it was a violation of plaintiff's First Amendment rights to terminate him for his publication of documents from defendant's internal grievance proceedings; and 2) the right was clearly established.
