United States Fourth Circuit

US v. Robertson, 12-4486

Defendant's conviction for being a felon in possession of a firearm is reversed, where: 1) in submitting to the search, defendant merely obeyed the police officer's orders without giving valid consent; 2) the search is presumptively unreasonable absent probable cause; and thus, 3) the district court erred in denying defendant's motion to suppress.
