Cooper v. Sheehan, 13-1071

In an action alleging claims under 42 U.S.C. section 1983, as well as state law claims, arising from an incident in which defendant-officers shot plaintiff while investigating a domestic disturbance on his property, the district court properly denied defendant-officers' assertions of qualified and public officers' immunity from, respectively, plaintiff's federal and state excessive force claims, where the district court correctly concluded that the defendant-officers' decision to use deadly force was not objectively reasonable.
