Radford v. Colvin, 13-1021

Judgment of the district court that plaintiff was disabled due to his back impairment and that he met the requirements Listing 1.04A, the regulation identifying disorders of the spine that merit a conclusive presumption of disability and an award of social security benefits, is vacated and remanded, where: 1) the district court did not err in its application of Listing 1.04A; however, 2) the district court's decision to direct the Administrative Law Judge to award benefits was an abuse of discretion.
