United States Fourth Circuit
US v. Dyess, 11-7335
The district court's denial of a habeas corpus motion challenging a conviction and life sentence for conspiracy to distribute cocaine, cocaine base, and conspiracy to commit money laundering, is affirmed, where: 1) the district court did not err in limiting its review to the 16 claims in the amended petition that were supported by facts and argument; 2) petitioner's argument based on Apprendi v. New Jersey, 530 U.S. 466 (2000) fails; and 3) the district court correctly dismissed petitioner's ineffective assistance of counsel claims, as to both trial and remand counsel.
