US v. Lespier, 12-4266

Defendant's convictions for first degree murder and related gun charge are affirmed, where: 1) the district court properly denied the acquittals; 2) the district court did not err in its evidentiary rulings; and 3) although the district court should have instructed on the second-degree murder offense, such error was invited by defendant and cannot be used to disturb his convictions or sentences.
