Moore v. Hardee, 12-6679

The district court's grant of petitioner's habeas corpus motion for relief from his conviction of first-degree burglary and assault with a deadly weapon with intent to kill inflicting serious injury, is: 1) reversed in part, as to the district court's judgment granting the petition on petitioner's claim of ineffective assistance based on his counsel's failure to call an expert in eyewitness identification; and 2) affirmed in part, as to the portion of the district court's judgment rejecting petitioner's other claims of ineffective assistance.
