In a dispute between competitors in the real estate listing business over defendant's use of plaintiff's copyrighted material, the district court's preliminary injunction order prohibiting defendant's display of plaintiff's photographs on defendant's referral website, is affirmed, where: 1) plaintiff's identification of photographs as preexisting material and the basis of the copyright claims in its copyright registrations satisfied the Copyright Act's pre-suit registration requirement; and 2) an electronic agreement may effect a valid transfer of copyright interests under Section 204 of the Copyright Act, and thus, plaintiff is likely to succeed against defendant in establishing its ownership of copyright interests in the copied photographs.
