On remand from the U.S. Supreme Court, the district court's dismissal of an action challenging two provisions of the Patient Protection and Affordable Care Act, the individual mandate and employer mandate, is again affirmed, where: 1) in light of the Supreme Court’s teachings in National Federation of Independent Business v. Sebelius, there is jurisdiction to decide this case; and 2) on the merits, dismissal of the complaint in its entirety is appropriate for failure to state a claim upon which relief can be granted.
