Sons of Confederate Veterans v. City of Lexington, 12-1832

The district court's ruling that defendant's ordinance, which banned private access to city-owned flag standards, is constitutional, is affirmed, where: 1) inasmuch as the ordinance was lawfully enacted to close a designated public forum, plaintiff's Free Speech claim was properly dismissed; and 2) because there is no constitutional violation posed by the ordinance, there could be no violation of a Consent Decree previously entered into by the parties.
