US v. Aparicio-Soria, 12-4603

The district court's application of a “crime-of-violence enhancement" to defendant's sentence for illegally reentering the United States, pursuant to U.S.S.G. section 2L1.2(b)(1)(A)(ii) on the basis of a previous Maryland conviction for resisting arrest, is affirmed, where: 1) the categorical approach applies; and 2) the Maryland offense of resisting arrest constitutes a crime of violence under section 2L1.2.
