ABB Inc. v. CSX Transp., Inc., 12-1674
In a suit against a transporter, alleging it was liable for full damage to cargo, the District Court's limitation of liability is reversed where: 1) the Carmack Amendment to the Interstate Commerce Act, 49 U.S.C. section 11706, subjected the transporter to full liability for the shipment; and 2) that the parties did not modify transporter's level of liability by written agreement as permitted in that statute.
