The North Carolina State Board of Dental Examiners v. Federal Trade Commission, 12-1172
Petition for review of the Federal Trade Commission (FTC) order finding that the petitioner violated the FTC Act, by excluding non-dentist teeth whiteners from the market in North Carolina, is denied, where: 1) petitioner is not exempt from the antitrust laws under the state action doctrine; 2) substantial evidence supported the finding that petitioner engaged in concerted action under section 1 of the Sherman Act; and 3) petitioner's activities unreasonably restrained trade under section 1 of the Sherman Act.
