United States Fourth Circuit

Dooley v. Hartford Accident & Indemnity, 12-1882

Summary judgment for defendant insurer in insurance coverage dispute is affirmed, where: 1) although defendant's automobile insurance policy failed to specify any particular amount of uninsured/underinsured motorist (UM/UIM) coverage, Virginia Code section 38.2-2206(A) mandates that UM/UIM coverage "shall equal" the general liability coverage, and thus, this provision provided plaintiff an equal amount of UM/UIM coverage under defendant's policy; and 2) the anti-stacking provision in the policy unambiguously prevents the stacking of UM/UIM coverage for each insured vehicle.
