United States Fourth Circuit

Coleman v. DEA, 11-1999

Summary judgment to defendant on plaintiff's action seeking production of documents concerning the federal government’s regulation of the drug carisoprodol that plaintiff originally requested under the Freedom of Information Act two years prior, is reversed and remanded, where, because defendant violated its statutory deadline for responding to plaintiff, plaintiff has exhausted his administrative remedies in this matter and properly brought suit seeking production of the records included in his initial request.
