US v. Allen, 12-4168

Conviction and sentence for conspiring to possess fifty grams or more of cocaine base with intent to distribute, are: 1) affirmed in part, where defendant's conviction was well supported by substantial evidence, and the district court committed no error in its pretrial evidentiary rulings; and 2) vacated and remanded as to defendant's sentence, where defendant is ineligible for the ten-year mandatory minimum sentence imposed because the Fair Sentencing Act applies to all sentences handed down after its enactment.
