US v. McLean, 11-5130

Defendant's convictions and sentence for health care fraud and making false statements in connection with the delivery of or payment for health care services, are affirmed, where: 1) the health care fraud statute is not unconstitutionally vague as applied to defendant; 2) substantial evidence supports defendant's convictions; 3) there was no due process violation in the non-disclosure of the civil settlement with the hospital; 4) the district court did not abuse its discretion in allowing voir dire of defendant's expert to remedy defendant's failure to provide adequate disclosures; 5) the district court did not abuse its discretion in excluding certain portions of defense expert's testimony, and even if error, it was harmless; and 6) defendant's sentence was reasonable.
