Spaulding v. Wells Fargo Bank, N.A., 12-1973

The district court properly dismissed plaintiffs' suit alleging defendants wrongfully denied their application for a mortgage modification under the Home Affordable Modification Program, where plaintiffs have not plausibly stated causes of action for breach of implied-in-fact contract, negligence, violations of the Maryland Consumer Protection Act, negligent misrepresentation, or common law fraud, sufficient to survive a 12(b)(6) motion to dismiss.
