Lansdowne on the Potomac v. Openband at Lansdowne, LLC, 12-1925
Judgment for plaintiff homeowners association in suit alleging that its contract giving defendant the exclusive right to provide video services to the plaintiff's development, violated an order of the FCC prohibiting such exclusivity arrangements is affirmed, where: 1) plaintiff has standing; 2) the FCC Exclusivity Order is sufficiently specific in defining the "rights and obligations of these litigants" to be enforceable; and 3) the contract provisions prohibit competing cable providers from accessing the plaintiff's development in patent violation of the FCC’s Order.
