Raymond James Financial Services, Inc. v. Cary, 12-1053

Defendant investors are not "customers" of plaintiff within the meaning of the Financial Industry Regulatory Authority (FINRA) arbitration provisions because they made their decision to invest independently of any recommendation on the part of plaintiff, and therefore, the district court properly granted plaintiff's motion for a permanent injunction barring arbitration of the defendants' claims.
