Noohi v. Toll Bros., Inc., 12-1261

In putative class action alleging that defendant real estate development company unlawfully refused to return deposits when the prospective buyers could not obtain mortgage financing, denial of defendant's motion to dismiss or stay complaint pending arbitration is affirmed, where the Agreement of Sale's arbitration provision is unenforceable for lack of mutual consideration under Maryland law.
