United States Fourth Circuit
Tobey v. Jones, 11-2230
In 1983 action alleging violations of plaintiffs' First, Fourth, and Fourteenth Amendment Equal Protection Clause rights when defendant-TSA agents seized and arrested him for displaying the text of the Fourth Amendment to the United States Constitution on his chest, district court's denial of defendants' motion to dismiss the First Amendment claim is affirmed, where the facts as alleged by plaintiff plausibly set forth a claim that the TSA agents violated his clearly established First Amendment rights.
