UBS Financial Services, Inc. v. Carilion Clinic, 12-2066
In declaratory judgment action brought in response to the initiation of arbitration related to advice rendered on issuance of bonds, the district court's denial of plaintiffs' motion to enjoin arbitration proceedings is affirmed, where: 1) defendant, by purchasing plaintiffs' services, was indeed a "customer" entitled to arbitration under FINRA Rule 12200; and 2) the forum selection clause relied on by plaintiffs did not have the effect of superseding or waiving defendant's right to arbitrate.
