United States Fourth Circuit

US v. Watson, 11-4371

In appeal from denial of motion to suppress evidence, and convictions for possession of firearms and ammunition by a felon, judgment is vacated and remanded, where: 1) defendant was seized without probable cause; 2) his three-hour detention constituted an unlawful custodial arrest in violation of his Fourth Amendment rights; 3) the district court erred in denying defendant's motion to suppress, because his incriminating statement was the product of his unlawful custodial arrest; and 4) the erroneous admission of defendant's statement was not harmless.
