US v. Pileggi, 10-5273

In appeal of an increased restitution order by the district court following Court of Appeal's remand for resentencing on the term of imprisonment, the judgment is affirmed in part, vacated in part, and remanded, where: 1) re-litigation of the restitution issue was foreclosed in this case because the Court of Appeal's opinion limited the district court to correcting only the incarceration term of defendant's sentence; and therefore 2) the district court erred when it increased the amount of restitution on remand.
