Blitz v. Napolitano, 11-2283

In plaintiffs' suit for declaratory and injunctive relief challenging the use of advanced imaging technology scanners and invasive pat-downs at airport screening check-points in the United States, district court's dismissal of the complaint is affirmed where: 1) the district court did not err in ruling that the Checkpoint Screening SOP constitutes an order of the TSA Administrator under section 46110; and 2) plaintiffs' claim that the appellate review procedures mandated by 49 U.S.C. section 46110 are inconsistent with due process and separation of powers is without merit.
