In a conviction of a defendant for crack cocaine-related offenses, although the United States Supreme Court's decision in Dorsey does not implicate the matters that have been actually decided, defendant's sentence is vacated and remanded for resentencing because the Fair Sentencing Act is applicable and has not been addressed.
