United States Fourth Circuit

Bird v. Comm'r of Soc. Sec. Admin., 11-1645

District court's judgment upholding the decision of the Social Security Administration denying a veteran's application for disability benefits is vacated and remanded where: 1) the ALJ erred in failing to give retrospective consideration to medical evidence created after petitioner's last insured date when such evidence may be reflective of a possible earlier and progressive degeneration; and 2) the ALJ erred in failing to accord adequate weight to petitioner's disability determination made by the Department of Veterans Affairs.
