Ellis v. Louisiana-Pacific Corp., 11-2319

In plaintiffs' putative class action against a manufacturer of Trimboard, a composite building product designed and marketed for use as exterior trim around windows and doors, district court's dismissal of the action is affirmed where: 1) the negligence claim is barred by North Carolina's economic loss rule; 2) the complaint fails to state a Unfair and Deceptive Trade Practices Act claim; and 3) the district court did not abuse its discretion in refusing to entertain plaintiffs' declaratory judgment claim.
